Introduction

This Privacy Policy describes how Birdie Management LLC (“Birdie,” “we,” “our,” or “us”) collects, uses, and safeguards your information in connection with its websites, apps, and related services (the “Services”). This Privacy Policy is part of our Terms of Service. Washington residents should review our separate Washington My Health My Data Privacy Notice below for additional rights.

PLEASE READ THIS POLICY CAREFULLY. BY USING THE SERVICES, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THIS PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

1. Types of Personal Information Collected

Depending on how you use the Services, this information may include, but is not limited to:

  • Health and wellness information (e.g., conditions, treatments, prescriptions, medical images, lab results, and related data)

  • Identity verification data (e.g., government ID, signature if required)

  • Billing and payment details (processed by our payment partners)

  • Account login credentials

  • Location data

  • Identifiers such as name, address, phone number, email, and date of birth

  • Purchase and transaction history

  • Customer service interactions

  • User-generated content and communications

  • Emergency contact information

  • Demographic information

2. Sources of Information

We collect information about you when you use the Services. Certain information is required to provide the Services. If you do not provide it—or ask us to delete it—you may lose access to some or all features. We collect information you submit directly, including when you: (i) Create or manage an account; (ii) Request products, treatments, or services; (iii) Contact us with questions, feedback, or support requests; (iv) Participate in surveys, research, promotions, or sweepstakes; (v) Upload or post content.

Third Party Sources: Birdie may receive information about you from third parties we work with to provide and improve the Services, including healthcare providers, pharmacies, service vendors, advertising and analytics partners, and marketing or search platforms. This information may be combined with data we collect directly or automatically to operate, personalize, and enhance the Services. If you access the Services through a third-party login or connection, you may permit us to receive certain information from that third party based on your account settings. We are not responsible for how those platforms handle your data. To limit sharing, adjust your privacy settings with the third party or avoid using those connections.

Social Media: If you interact with Birdie on social media or other content platforms (such as by liking, following, commenting, or entering promotions), we may collect information you make available to us, such as your name, email address, and public content.

Automated Collection: When you use the Services, Birdie and its service providers automatically collect technical and usage data about your device and interactions with the platform using cookies, SDKs, pixels, and similar technologies. This may include IP address, device and browser type, operating system, language, time zone, referring/exit pages, pages viewed, time spent, search terms, downloads, error logs, and related activity data. We may collect general location information (e.g., city, state, postal code, or IP-based location) to provide location-relevant content and services. We will request your consent before collecting precise GPS data. You may disable location sharing through your device settings. With consent where required, we and our partners use tracking technologies to recognize your device, store preferences, improve functionality, analyze performance, deliver relevant content and advertising, and support security and administration. You can manage cookie preferences through our Cookie Consent tools.

3. Purpose of Information Collection

Birdie uses your information to operate, support, improve, and secure the Services and to facilitate healthcare services provided by independent Providers. Subject to your consent and applicable law, we may use your information to:

  • Provide and manage the Services, including account administration, identity verification, payment processing, order fulfillment, and supporting Providers and pharmacies in delivering care.

  • Communicate with you, including service-related notices, responses to inquiries, and messages on behalf of Providers or pharmacies, as well as marketing, surveys, and promotional communications where permitted by law.

  • Improve and personalize the Services, including research, analytics, performance monitoring, and development of new features, using de-identified and aggregated data where appropriate.

  • Deliver relevant content and advertising, measure effectiveness, and tailor experiences based on your interests and usage.

  • Provide customer support and technical assistance, and troubleshoot issues.

  • Protect the Services and our users, including fraud prevention, security monitoring, and enforcing our Terms.

  • Comply with legal obligations and respond to lawful requests, and establish, exercise, or defend legal rights.

  • Any other purpose disclosed at the time of collection or with your consent.

Any health-related information is used and disclosed only as permitted by applicable federal and state laws, and we require third parties who process such data on our behalf to do the same. We may combine information we collect from you with data from other sources and use it as described in this Privacy Policy. We may create and use de-identified or aggregated information for any lawful purpose, including research, analytics, and marketing, and may share such data with third parties.

4. Communications, Advertising, and Online Analytics

SMS Communications
By providing your phone number and opting in, you consent to receive recurring marketing and non-marketing text messages from Birdie (SMS/MMS), including service updates, account notices, and promotional offers. Message frequency may vary, and standard message and data rates may apply. You can opt out at any time by replying STOP. Consent to receive texts is not a condition of purchase, and you may use the Services without agreeing to SMS messages.

Advertising
When you use mobile apps or mobile browsers, you may receive tailored in-app or mobile ads. Your device operating system (e.g., iOS or Android) provides controls to limit or opt out of personalized mobile advertising. Birdie does not control those settings and is not responsible for how platform providers manage ad preferences. Birdie may work with advertising networks and partners (such as Google, Meta/Facebook, TikTok, and others) that use cookies and similar technologies to show you relevant content and advertising on the Services and on other websites and apps. Ads may be based on your activity on the Services and across other online services over time. We may also share limited customer information (such as an email address) with advertising partners in hashed or de-identified form so they can help deliver more relevant ads. You can control targeted advertising through our Cookie Consent tools, your browser or device settings, and third-party ad preference platforms. Even if you opt out, you will still see ads, but they may be less relevant. Birdie does not control third-party advertising technologies placed by non-affiliated companies, and their use is governed by their own privacy policies.

Analytics & Measurement
Birdie and its service providers use analytics tools (such as Google Analytics, Mixpanel, and similar technologies) to understand how users interact with the Services. These tools collect information through cookies, SDKs, pixels, and related technologies to help us operate, improve, secure, and personalize the Services, measure performance, prevent fraud, and develop new features. Some tools may enable cross-device or cross-browser analytics where permitted by your settings and applicable law. You can manage your preferences through your device settings, browser controls, or Birdie’s Cookie Consent and “Your Privacy Choices” tools. If you receive emails from Birdie, we may use tracking technologies (such as clear GIFs) to see whether messages are opened or links are clicked, which helps us evaluate and improve our communications.

5. Sharing of Personal Information

We may sell or share your sensitive personal data as permitted by law. Birdie may share your information with your consent in ways you direct us to or expressly authorize. With your consent where required, Birdie may disclose your information for business and operational purposes in the following ways:

Affiliates and Related Companies: We may share information within Birdie and its affiliates to provide, support, and improve the Services and ensure consistent user experiences.

Healthcare and Pharmacy Partners: We share information with licensed healthcare providers, pharmacies, and related service partners to schedule visits, deliver care, process prescriptions, and support treatment, payment, and healthcare operations at your request.

Service Providers: We share information with third-party vendors who perform services on our behalf, including billing, payment processing, shipping and fulfillment, marketing, analytics, research, IT and security, fraud prevention, auditing, legal, and customer support. These providers may include healthcare organizations and pharmacies supporting the Services.

Advertising and Marketing Partners: Unless you opt out, we may share certain information with advertising networks and marketing partners to deliver relevant content and measure advertising effectiveness, as described in the “Online Analytics and Advertising” section.

Joint Service Offerings: We may share information with entities that jointly offer products or services with Birdie. These partners collect and use data under their own privacy policies.

Legal, Safety, and Rights Protection: We may access, retain, and disclose your information if we believe in good faith that doing so is necessary to: (i) investigate or prevent fraud, security issues, or misuse of the Services; (ii) protect the rights, property, or safety of Birdie, our users, or the public; (iii) enforce our Terms, Privacy Policy, or other agreements; (iv) comply with applicable laws, regulations, or legal process; or (v) respond to customer service requests.

Public Content and User Interactions: Any information you post publicly or share with others through the Services is not confidential. We may use such content for any lawful purpose, including marketing or testimonials. We are not responsible for how others use information you choose to make public.

Testimonials and Reviews: If you submit reviews, feedback, images, or other materials, you grant Birdie permission to use your name, likeness, and content in marketing and promotional materials.

Aggregate and De-Identified Data: We may create and share de-identified or aggregated data for any lawful purpose, including research and marketing.

Business Transfers: If Birdie is involved in a merger, acquisition, financing, restructuring, or sale of assets, your information may be transferred as part of that transaction, subject to applicable legal restrictions.

6. Your Choices and Rights

Cookies and Tracking Technologies: You can manage cookies through our Cookie Consent tools and your browser settings. Disabling cookies or similar technologies may limit certain features of the Services.

Communications Preferences: You may opt out of marketing emails at any time by clicking the “Unsubscribe” link in those messages. You may still receive non-marketing, service-related communications. You can also manage preferences by emailing support@withbirdie.com.

Rights: Depending on your state of residence, you may have the right to: (i) Opt out of direct marketing and certain profiling; (ii) Request access to, correction of, or deletion of your personal information; (iii) Restrict or object to certain processing or disclosures; (iv) Request data portability; (v) Withdraw consent where processing is based on consent.

You may request that we update or delete your personal information by contacting us at support@withbirdie.com. We will use commercially reasonable efforts to honor valid requests, subject to applicable law and our record-keeping obligations.We will respond to verified requests within the time required by applicable law. Some information may be exempt where we must retain it for legal, regulatory, or legitimate business purposes. We may require identity verification before processing any request. To exercise your rights, email support@withbirdie.com with your name, email, and state of residence. If we deny your request, you may appeal by emailing legal@withbirdie.com with the subject line “Privacy Appeal.” We will handle appeals in accordance with your state’s laws. You may also file a complaint with your state Attorney General. California residents may request certain information about our disclosures of personal information to third parties for their direct marketing purposes.

7. Protection of Your Information

Birdie uses reasonable technical, administrative, and organizational safeguards to protect your information from loss, misuse, unauthorized access, disclosure, alteration, or destruction. However, no system is completely secure. You acknowledge that any transmission of information to or through the Services is at your own risk, and we cannot guarantee absolute security. If you create an account, you are responsible for maintaining the confidentiality of your login credentials. Do not share your password. Information you post in public areas may be visible to others.

Our Services are not intended for individuals under 18. We do not knowingly collect personal information from children under 13. If we learn that we have done so, we will delete that information as soon as reasonably possible. If you believe a child has provided us with personal information, contact support@withbirdie.com.

8. Information Retention

We retain your information only as long as necessary to fulfill the purposes for which it was collected, including to provide the Services, meet legal or regulatory obligations, resolve disputes, and enforce our agreements. Retention periods are determined based on the nature and sensitivity of the data, the risk of harm from unauthorized use or disclosure, the purposes for processing, and applicable legal requirements.

9. Privacy Policy Revisions

We may update this Privacy Policy from time to time to reflect changes in law, technology, or our practices. The most current version will always be available through the Services, with the revision date noted at the top. We will provide notice as required by law if we make material changes. Continued use of the Services after any update constitutes acceptance of the revised Policy.
